Challengers Social Contest

By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below and in the Social Contest Post(s), which form part of these Official Contest Rules & Regulations (collectively, the “Contest Rules”) for each applicable Daily Contest Period you enter.  

Sponsor: The sole Sponsor of this Contest is Cineplex Entertainment LP (“Cineplex” or “Sponsor”). 

NO PURCHASE NECESSARY. Contest commences on April 22, 2024 and ends at 11:59 pm EST on April 26, 2024. (“Contest Period”).

1. ELIGIBILITY

Contest is open to individuals who are legal residents of Canada (excluding Quebec) who are over the age of 14 at the time of entry.   Additional eligibility criteria may apply to certain Prize(s), and will be communicated in the Social Contest Posts for the applicable Prize(s) and posted here. Contest is not open to employees and those domiciled with employees of Sponsor or its parent, subsidiary or affiliated companies, licensees or advertising and promotional agencies or prize providers (collectively, the “Contest Parties”). Sponsor reserves the right to verify eligibility of potential prize winners including but not limited to verifying that potential prize winners are not an employee (or domiciled with employees) of any of the Contest Parties, and without verification to the sole satisfaction of Sponsor, to deny entry to that entrant. Void where prohibited.  

1. HOW TO ENTER

NO PURCHASE NECESSARY. Before entering the Contest, ensure post setting is set to “Public” prior to submitting your post on your Facebook or Instagram account. To enter the Contest, you must follow @CineplexMovies, @TheRecRoomCA and @PlaydiumCA. Sponsor will post one or more Contest related posts (each a “Social Contest Post”) on the Cineplex, The Rec Room and/or Playdium Facebook and Instagram pages (collectively the “Sites”).  Entrants must like the Social Contest Post, leave a comment, and tag a friend during to be eligible to win the applicable Prize.    In the event that the Sponsor determines that an entrant has submitted more than one entry, using one or more Facebook/Instagram accounts, all entries will be void and that entrant will be disqualified at the sole discretion of Sponsor. 

Any comments that, (i) infringe or violate the rights of any third party; (ii) contain materials that are inappropriate, indecent, contain profanity, sexual content, hateful content of any kind; (iii) contain materials that promote violence or harm to another living creature or any other offensive content (as determined by Sponsor in its sole discretion) or content that could adversely affect the name, reputation, or goodwill of any Contest Party; or (iv) contain materials that promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing) or promote any activities that may appear unsafe or dangerous; shall be ineligible for entry into this Contest, and Sponsor, at its sole discretion may disqualify the entrant from entering this Contest or winning any Prize.  

Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with the selected potential Prize winner. Posts that are deleted by Facebook or Instagram for any reason, including but not limited to violation of the Facebook or Instagram terms and conditions, will be invalid and the entrant will be disqualified.  

Entries received shall be deemed to be submitted by the person in whose name the identified Facebook or Instagram account was registered. For the purpose of the Contest Rules, “authorized account holder" of a Facebook or Instagram account is defined as the natural person who is assigned to the Facebook or Instagram account by Facebook, Instagram and/or an on-line service provider. Potential Prize winners may be required to provide the Sponsor with proof that they are the authorized Facebook or Instagram account holder associated with the winning entry. 

1. THE PRIZE

There are three (3) prize packs (“Prize Pack”) available to be won. 

The prize pack consists of the following: 

• 1x Challengers Themed Sweater
• 1x Challengers Themed Shirt

The approximate retail value of each prize is sixty dollars (CAD $60.00).

All Prizes must be accepted as awarded without substitution and are not transferable or redeemable for cash or allowed to be sold, and no warranties or guarantees regarding any Prize is expressed or implied. The Sponsor and any prize provider reserve the right to substitute a Prize in whole or in part in the event that all or any of the components of the Prize are unavailable. In the event that a winner is unable to redeem any or all of the Prize components due to reasons beyond the control of the Contest Parties, or their respective employees, representatives, or agents, no compensation or substitute Prize will be provided.

1. CONTEST DRAW

Sponsor will select in a random drawing in Toronto, Ontario on or about 12:00PM EST on April 29th, 2024. The Sponsor will attempt to contact the potential winners by direct message to the potential winner’s social media account used for the selected entry, with instructions on how to contact Sponsor to complete the Prize verification process. Potential Prize winner will have three (3) business days to contact the Sponsor. In the event that a potential Prize winner does not contact Sponsor within the specified period of time, they will be disqualified, and another entrant may be selected from the remaining eligible entrants. This process shall continue until the potential Prize winners are selected. Potential Prize winners must correctly answer a mathematical skill-testing question to be administered by in writing and sign a declaration and release form: (a) discharging and releasing the Contest Parties and their respective  partners, parent, subsidiary or affiliated companies, officers, directors, shareholders, or employees (collectively, the “Released Parties”) from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or non-use of the Prize; (b) confirming compliance with the Contest Rules; (c) consenting to the publication and/or use, in any medium of your name, and city of residence for publicity purposes carried out by the Sponsor for without payment or compensation of any kind; and (f) accepting the Prize, as awarded (a “Declaration and Release Form”).   In the event that the any potential winner is under the age of majority in their province of residence, their parent or legal guardian may be required to sign the Declaration and Release Form on their behalf. If the parent or legal guardian does not agree to sign the Declaration and Release Form on behalf of their minor child, that potential winner will be disqualified and no longer eligible to win the Prize. 

1. GENERAL RULES

None of the Released Parties shall be liable for lost, late, incomplete, misdirected, not received, stolen, mutilated, or garbled entries. By entering this Contest, entrants accept and agree to be bound by these Contest Rules and the decisions of the Sponsor, which are final, binding and conclusive on all matters relating to this Contest. The Sponsor reserves the right to disqualify all entrants who fail to follow these Contest Rules or who make any misrepresentation relating to the Contest, drawing and redemption of the Prize. This Contest is subject to all applicable federal, provincial and municipal legislation. Entry constitutes permission to use the winner’s name, photograph and/or voice recording for publicity purposes without additional compensation or permission, except where prohibited by law.  

1. PRIVACY

This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Any personal information that is collected by the Sponsor will be handled in strict accordance with the Cineplex Privacy Policy, available at http://cineplex.com/Global/PrivacyPolicy and all applicable privacy legislation. Sponsor will not sell your personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Sponsor as is disclosed herein. Please note that by submitting personal information to enter this Contest, you consent to Sponsor’s use of your personal information in order to manage and administer this Contest.  

1. TECHNICAL DIFFICULTIES AND TAMPERING

The Sponsor shall not be responsible for any failure of the website during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, or failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer, or property related to or resulting from playing or downloading any material in the Contest. The Sponsor reserves the right, at its sole discretion to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Sponsor is also not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Contest Rules, the selection and announcement of winners, or the distribution of the Prizes. 

1. NO LIABILITY

The Released Parties shall not be responsible in any way for the use of or bear any liability whatsoever in any way attributable to, any Prize awarded in this Contest or the events forming part of this Contest. By participating in the Contest or participating in or accepting any Prize, all entrants release, identify and hold harmless the Released Parties from any and legal claims, demands, damages, action and/or causes of action, all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or nonuse of any Prize or part thereof, and from liability to any other persons relating to or resulting from entering this Contest.  None of the Released Parties make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of the Prizes, including, without limitation, quality, merchantability, and fitness for a particular purpose.   

1. SPONSOR HAS FINAL SAY

Decisions of the Sponsor are final and binding with respect to all aspects of this Contest. 

1. CLOSE OF CONTEST

The Contest will close at 11:59 pm EST, on April 26, 2024. However, the right is reserved by the Sponsor to withdraw, terminate or modify this Contest and the Contest Rules at any time without prior notice.   In the event that it is not possible to award another entry due to discontinuance of the Contest for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the Prizes offered herein. 

1. GOVERNING LAW

All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest or the Contest Rules or the rights and obligations as between the entrants and Sponsor in connection with the Contest shall be governed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws. All parties hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Contest or the Contest Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.
